中国首次对“碰瓷”行为将依法严惩

中国公安部10月14日召开新闻发布会，通报最高法、最高检以及公安部联合印发的《关于依法办理“碰瓷”违法犯罪案件的指导意见》有关情况。这是第一次对“碰瓷”行为作出准确界定，为司法实践提供了指引。

据最高人民法院研究室副主任周加海表示，对于“碰瓷”犯罪集团中的首要分子、骨干分子，多次“碰瓷”特别是屡教不改者，以及后果特别严重、影响特别恶劣的，要作为打击重点依法严惩。

《指导意见》主要规定了“碰瓷”行为的定性处理、公检法辦案部门分工配合、加强宣传教育等內容。人民法院将依法严惩“碰瓷”犯罪，为维护群众合法权益、维护社会秩序提供更有力司法保障。一是规定了对“碰瓷”违法犯罪活动的定性处理。二是对公检法机关办理此类案件提出明确工作要求。三是严格落实宽严相济的刑事政策和认罪认罚从宽制度。四是强化宣传教育，在全社会营造良好氛围。
